Office-to-home conversion rights come into force


New permitted development rights allowing for offices to be converted into homes without the need for planning permission come into force today.

The rights are set out within an Order which was laid before Parliament earlier this month. Areas within 17 local authorities will be exempt from the right, including the Central Activities Zone and Tech City in London as well as areas in the Isle of Dogs and the Royal Docks Enterprise Zone.

The Order also includes the right for extensions to homes up to eight metres to proceed without planning permission as well as an increase in the thresholds for permitted development rights for change of use from business or general industry to storage and distribution and from general industry or storage and distribution to business from 235 square metres to 500 sq m.

Retail shops, financial and professional services, restaurants, cafes and businesses may open for up to two years in buildings designated as shops, financial services, restaurants, pubs, hot food takeaways, business, non-residential institutions, leisure and assembly under provisions in the Order.

New Regulations also come into force today which limit the circumstances in which compensation is payable when a development order granting planning permission is withdrawn and an application for that development is subsequently refused or made subject to conditions.

Under the new Regulations, compensation will only be payable if the planning application for the development is made within a 12 month period of the date the development order was withdrawn. The Regulations also set out a procedure for withdrawal of the development order which, if followed, allows for no compensation to be payable.
