Pickles confirms Shepherds Bush Market CPO


Secretary of state for communities and local government (SoS) Eric Pickles has confirmed an order by Hammersmith and Fulham Council that will enable the proposed regeneration scheme at Shepherds Bush Market in west London to go ahead.

The Council made a compulsory purchase order (CPO) in February 2013 to acquire all the property interests needed for joint venture Orion Shepherds Bush Limited's plans to expand and redevelop Shepherds Bush Market. The proposals, which received planning permission in 2012, include 207 new homes, 65,000 square feet of new market space, 43,000 sq ft of cafes and restaurants and 43,000 sq ft of community space.

A public inquiry into the CPO was held by planning inspector Ava Wood in September and November last year. The inspector recommended in her report (94-page / 986 KB PDF) that the order should not be confirmed by the SoS, saying that "guarantees and safeguards are not sufficiently robust to be assured that genuine opportunities exist for current traders or shopkeepers (or similarly diverse businesses) to continue trading in the market and Goldhawk Road".

In a decision letter dated 10 October (6-page / 141 KB PDF), Pickles disagreed with the inspector's recommendation, concluding that "sufficient safeguards are in place to protect traders and shopkeepers through a series of planning conditions requiring the review and approval of the Council and through the Section 106 agreement which can be enforced by the Council to ensure that a development in line with the relevant planning framework can be delivered".

The SoS found that the proposal would "significantly contribute to the economic, social and environmental well-being of the area" and that the benefits of the scheme outweighed the interference with the human rights of those parties with interests in the affected land.

Pickles confirmed the order with minor modifications requested by the Council, removing Lime Grove Hostel, to the west of the railway viaduct at Shepherds Bush Market, from the CPO.
