Hong Kong porn site operator arrested

OUT-LAW News, 28/08/2001

Police in Hong Kong have arrested a 29 year-old man in connection with the alleged operation of a web site featuring pornographic material. Under Hong Kong law, the man could now face up to three years in prison and a fine of HK$1 million( £89,000), according to an article by Newsbytes.

Under the Control of Obscene and Indecent Articles Ordinance in Hong Kong, any form of publication of obscene articles is forbidden. Articles which are held to be indecent may be published but must carry a statutory warning and have access to them restricted to those over the age of 18.

Whether an article is “obscene” or “indecent” under Hong Kong law is the decision of the Obscene Articles Tribunal. It will consider factors such as the standards of morality and decency in the article, the dominant nature of the article as a whole and the class and age groups of those at whom the article is aimed.
