New York consumers can jointly sue Microsoft

OUT-LAW News, 06/09/2005

A class action suit brought by New York consumers against Microsoft can proceed, a New York judge has ruled. According to Law.com, the consumers charged that they suffered damages as a result of deceptive behaviour by the company.

Advert: Phishing conference, London, 27th October 2005In the years since Microsoft was first confronted with an antitrust lawsuit filed by the US Department of Justice and 20 states, a number of antitrust class action lawsuits have been filed against it, alleging that the firm eliminated competition from superior and cheaper rivals in its main software markets.

Like the original Justice Department suit, all but a few have settled. The New York action, initially filed in 2000, is among those still active; and New York Supreme Court Judge Karla Moskowitz has finally certified the case for class action status.
