Worker with MS was unfairly dismissed, says tribunal

A council worker was unfairly sacked after being diagnosed with multiple sclerosis, a tribunal has ruled, according to reports.

Syria Akram won her case for unfair dismissal and disability discrimination against Calderdale Council in Halifax.

The 30-year-old community safety officer was accused of gross misconduct by her employer when discrepancies were found in her time sheet. Akram argued that the MS left her tired and forgetful. She said she sometimes forgot to sign-in when she arrived at work.

Ben Doherty, an employment law specialist with Pinsent Masons, the law firm behind OUT-LAW.COM, said the case serves as a valuable reminder for all businesses. "Employers have to make adjustments for staff with disabilities. The ruling is unsurprising: fatigue is common consequence of MS and employers must make allowances for that."

Compensation will be determined at a future hearing.
