David McIlwaine's biography
David is a Senior Associate in the Outsourcing & Technology
Group. Prior to joining the firm David worked in-house in the
legal department of Oracle Corporation (UK) Ltd.
David advises clients on IT project disputes and has acted on a
number of large scale and technically complex IT projects, on
behalf of both suppliers and users. In addition, he has
provided support to clients with problem IT projects, assisting
clients to re-assess the project and to take remedial action, by
way of re-negotiation or otherwise.
Experience includes:
- Advising a central government department in relation to a high
value claim against a leading US supplier; the dispute involved a
troubled IT system developed during a long-term outsourcing
relationship
- Advising a Non-Departmental Public Body in relation to security
and audit problems experienced on an electronic document and
records management system
- Advising the Council of the University of Cambridge in relation
to the CAPSA project, a troubled commitment accounting system
- Representing a large UK services company in relation to dispute
stemming from a major PFI contract for the development of an
electronic ticketing system for a mass transportation network.
- Representing United Assurance Group in its High Court action
against UNISYS, concerning the failed implementation of a life and
pensions system
- Advising an international engineering company in relation its
troubled IT outsourcing contract, with the subsequent
re-negotiation of that contract
- Advising the Bank of Ireland on the early termination of a long
term outsourcing agreement and negotiating the exit strategy.
David produced a guide on behalf of the Computer Services and
Software Association (now Intellect) and CEDR Solve explaining the
benefits of mediating IT disputes. He is assistant editor of
our Computer Law Reports and has written numerous summaries and
commentaries on recent case law relevant to the I&T
industry.
