Pinsent Masons seeks a 4+ year qualified disputes lawyer to work within the London Outsourcing Technology and Commercial Group (the OTC group), focusing on IT projects in both the public and private sectors.   

The OTC Group

Pinsent Masons' OTC Group is a national team of over 100 partners and lawyers, advising on all aspects of information, technology and communications law, including systems integration, software development, intellectual property, telecoms, information law including data protection, outsourcing (IT, BPO and PPP), intellectual property, e-commerce, and new media.   

Named by The Lawyer as IP/IT Team of the Year in 2006, the team is an integrated mix of commercial and litigation lawyers.  There is a strong commitment to know-how with the Group supported by two PSLs.  

The Group's clients include a number of household name IT suppliers and various public and private sector customer organisations. The Group has acted on many high profile and high value IT projects. Legal 500 has long recognised Pinsent Masons as one of the leading firms in IT in general and IT disputes in particular. The team also undertakes a substantial number of IP disputes including copyright, patent and trade mark work in the life sciences and media sectors.

The role

The work will mainly involve assisting with large scale IT project disputes which stem from software integration and implementation agreements, software development agreements, services agreements, outsourcing agreements etc. Although dispute related, much of the work will involve assisting clients' with difficulties that arise during the life of the project, possibly leading to the renegotiation of the agreement, or the restructuring of the project. Advice is also provided in relation to the ability to lawfully terminate IT projects, the enforceability of limitation and exclusion clauses, and the various remedies available in the event of breach. 

In addition, it would be desirable if the candidate had experience of IP disputes, as there is also the opportunity to undertake work in this area.

The candidate will be expected to assist with the day-to-day running of disputes or particular aspects of a dispute, and should expect a good degree of client contact.

Skills

Candidates will be required to have the following skills or experience:

  • the ability to work effectively as a member of a team, and to supervise other members of the team;
  • self-motivation;
  • experience of 'heavy' litigation, particularly project based litigation, preferably including experience of IT disputes and IP disputes;
  • experience of ADR, including mediation and arbitration;
  • an analytical mind, with close attention to detail and a good grasp of contract law as it applies to projects.

A technical background is not required. The candidate will, however, be expected to have knowledge of issues affecting the IT industry in a legal context. The candidate should be committed to concentrating on the IT sector. This is not a general commercial litigation role, although experience of general commercial litigation will be useful.
